Emanuel Cordroch schlägt eine Brücke vom Rechtsstaatsprinzip zur Unrechtshaftung und schließt hieraus auf eine Neuordnung des Staatshaftungsrechts: Die Untersuchung fußt auf einer rechtstheoretischen Analyse von Staatsakt, Rechtspflicht und Rechtsverletzungsfolge. Ausgangspunkt ist das vom Autor hergeleitete Prinzip der qualifizierten Rechtsbindung des Staates. Danach ist der Staat – im Unterschied zum Privaten – dem Recht kraft Art. 20 Abs. 3 GG in gesteigerter Weise verpflichtet. Auf dieser Grundlage wird die rechtsstaatliche Forderung nach einer Pflicht zur Unrechtshaftung begründet. Dieser Staatspflicht wird der auf Art. 34 Satz 1 GG gestützte und vom Autor entwickelte allgemeine Unrechtsanspruch zur Seite gestellt.

The study centres on a principle Cordroch derives from the rule of law: the state is more strictly bound by law than private persons are. Building on this concretisation, Cordroch develops a system of legal consequences, thereby substantiating the claim that the rule of law supports state liability for unlawful conduct.
