Throughout the 20th century, legal rules on piracy
were largely perceived as historical relicts in national and international
codifications and were only rarely applied in practice. It was only with the upsurge
of pirate attacks off the coast of Somalia in 2008 that the law on piracy came to the
fore again. This contribution provides an overview of selected national legal
frameworks of African states pertaining to piracy and armed robbery at sea. It
further deals with the question of what regional legislative approaches could be
taken in order to prevent, suppress, and prosecute piracy more effectively.

Tout au long du 20e siècle, les règles juridiques applicables à la piraterie maritime
ont largement été perçues comme des vestiges historiques de codifications nationales
et internationales mais rarement mises en œuvre en pratique. Ce n’est qu’avec
l’augmentation d’actes de piraterie maritime au large des côtes somaliennes en 2008
que le droit de la piraterie maritime s’est à nouveau imposé à l’attention de tous.
Cet ouvrage présente ainsi le cadre juridique national portant sur la piraterie
maritime et les vols à main armée en mer dans différents États africains. Il traite
également de la question de savoir quelles sont les approches législatives régionales
qui pourront être mises en œuvre en vue de prévenir, réprimer et poursuivre plus
efficacement la piraterie maritime.
