In gesellschaftlichen Krisenzeiten erweist sich das Recht als zentrales Steuerungsinstrument. Dabei stellt sich die Frage nach dem wissenschaftlichen Stellenwert rechtlicher Verhaltenslenkung: Muss das Recht als Instrument der Steuerung betrachtet werden oder gerat damit die dem Recht eigene Mechanik aus dem Blick? Daruber hinaus ist zu klaren, ob das Recht planvoll-lenkend die Realitat gestalten und gewunschte Veranderungen herbeifuhren soll, oder ob es sich vielmehr darauf beschranken sollte, bestehende Entwicklungen abzubilden. Welche Rolle spielt also die Lenkung von Verhalten fur das Recht? Gefahrden unwirksame Rechtsnormen die Geltung des Rechts? Wie beeinflusst der “Reiz des Verbotenen”, betrachtet durch die Reaktanztheorie, die rechtliche Steuerung? Welche Funktion ubernehmen Gerichte in diesem Zusammenhang? Kann Rechtstreue als Ausdruck eines gegenseitigen Respekts verstanden werden? Und wie gestalten sich die Wechselwirkungen zwischen Recht und Moral? All diesen Fragen und weiteren Aspekten widmet sich der vorliegende Tagungsband, der die Diskussionen der 30. Tagung des Jungen Forums Rechtsphilosophie im September 2022 in Koln zusammenfasst.
