This book analyses the logical and normative reasons for this opposition, successively comparing responses from the schools of the Commentators, Exegesis, Free scientific research, and contemporary hermeneutics. French description: La question de l’interpretation juridique a donne lieu historiquement a une succession de conflits entre les partisans de la cloture interpretative du Droit et les defenseurs du pouvoir createur du juge. Les premiers concoivent l’application des regles de droit aux cas particuliers comme une simple subsomption des espece sous leurs genres. Les seconds, au contraire, reconnaissant a l’interprete le pouvoir de completer, de suppleer ou de modifier le contenu des categories juridiques impliquees par ces regles, pour mieux integrer la diversite des circonstances empiriques. Le livre tente d’analyser les raisons logiques et normatives de cette opposition, en comparant les reponses donnees successivement par les Commentateurs, l’Ecole de l’Exegese, la Libre Recherche et l’Hermeneutique contemporaine.
