The new edition presents a fundamentally revised draft legislation together with its explanatory memorandum, incorporates recent medical developments, updates the comparative legal perspective, and analyses the latest jurisprudence on the right to a self-determined death. At the same time, it outlines the legal framework for possible reform.

The draft legislation and its explanatory memorandum have been fundamentally revised for the new edition. This revision has been prompted not only by recent medical developments but also by the ongoing and highly contentious debate on assisted dying. In particular, the evolving jurisprudence following the Federal Constitutional Court’s landmark decision of 26 February 2020 on the right to a self-determined death has opened up new critical perspectives. Against this backdrop, updating the comparative legal perspective likewise provides an opportunity to reassess one’s own position within the full range of regulatory approaches and alternatives. In this way, the federal legislature may succeed in fulfilling its constitutional obligation to regulate suicide prevention and assisted dying in an appropriate manner.
