Volume 4 of the large commentary on the Code of Civil Procedure covers sections 271-327 and thus central standards of first-instance civil proceedings. Case law and literature have been comprehensively evaluated.
English summary: Volume 4 of the commentary is now available in a new edition. The Stein ZPO – indispensable for complex issues in academia and practice. The high academic quality of the work and the deep penetration of the subject matter made possible by its scope have been trademarks of this work for decades and are appreciated by users. On the basis of reforms that have come into force, the latest case law and current literature, the authors of this volume present a systematic preparation of the standards to be commented on. What is new? The changes introduced by the Act to Promote the Use of Video Conferencing Technology in Civil and Specialized Courts (BGBl. I 2024, No. 237) have been taken into account in the commentary. The provision on electronic files (section 298 a ZPO) takes into account the amendment by the Act on the Further Digitization of the Judiciary of 12.07.2024 (BGBl. I No. 234), as well as the electronic file management that has been mandatory since 1.1.2026. In particular, the new Section 273a of the German Code of Civil Procedure (ZPO) on the confidentiality of business secrets, which was introduced by the Act to Strengthen the Judiciary (BGBl. 2024 I, No. 302) with effect from April 1, 2025, was commented on for the first time. Section 305b ZPO, inserted by the Act Implementing the Conversion Directive (BGBl. 2023 I, No. 51) with effect from March 1, 2023, is also included in the new edition. The edition is published in 12 volumes. These can be ordered individually or by subscription. The commentary is available digitally on the beck-online platform. Fabian Bunnemann https://dierezensenten.blogspot.com/2020/06/rezension-zivilprozes
