Volume 12 of the HKW contains Kelsen’s opus magnum ‘Allgemeine Staatslehre’ from his Viennese years. The first comprehensive presentation of his Reine Rechtslehre, it was to mark the beginning of the heated phase of the Weimar Richtungs- und Methodenstreit.


English summary: Volume 12 of the HKW contains ‘Allgemeine Staatslehre’, the groundbreaking work that was to help set in motion the Weimar Richtungs- und Methodenstreit of the 1920s. Terminologically drawing on the tradition culminating in Georg Jellinek’s classic work, Kelsen deprives the General Theory of the State of its methodological basis. In fact, his ‘Allgemeine Staatslehre’, written at the zenith of his Viennese years, marks the first comprehensive exposition of the Pure Theory of Law. In other words, this was the ‘zero edition’ of the ‘Reine Rechtslehre’, which then already bore all the typical characteristics of the first edition published in 1934, such as the juxtaposition of the (nomo)static and (nomo)dynamic view, the unity of state and legal order, the deconstruction of the traditional dichotomy of public and private law as well as the concept of the basic norm (Grundnorm). German description: Band 12 der HKW enthalt mit der “Allgemeinen Staatslehre” jene bahnbrechende Schrift, die fur den Weimarer Richtungs- und Methodenstreit mitursachlich ist. Terminologisch an die Tradition anknupfend, die in Georg Jellineks Klassiker kulminiert, entzieht Kelsen der Allgemeinen Staatslehre herkommlicher Art den methodologischen Boden. In der Sache markiert seine auf dem Zenit seines Wiener Wirkens verfasste “Allgemeine Staatslehre” die erste Gesamtdarstellung der Reinen Rechtslehre, also gleichsam die “Nullte Auflage” der “Reinen Rechtslehre”, die bereits alle wesentlichen Kennzeichen der 1934 publizierten Erstauflage tragt wie namentlich die Entgegensetzung von (nomo)statischer und (nomo)dynamischer Betrachtung, die Einheit von Staat und Rechtsordnung, die Dekonstruktion der als rechtswesenhaft gedachten Dichotomie von Offentlichem Recht und Privatrecht oder die Lehre von dem in der Grundnorm gipfelnden Rechtserzeugungszusammenhang.
