Is the Holiness Code law, or rather, how do its legal parts relate to the non-legal parts? Matthias Hope clarifies the Holiness Code’s categorization as law in a multidimensional way, including insights from legal anthropology. He sheds light on the interaction of legal and ethical elements also employing results of “emotion studies.” Reflections on holiness reveal its key role as a mediating element between law and ethos. Thus, the intentional blending of law, ethos, and cult becomes recognizable.
Ist das Heiligkeitsgesetz wirklich als Recht zu verstehen? Oder praziser: In welcher Form genau ist es als Recht zu verstehen? Wie verhalten sich also die nicht-rechtlichen Anteile von Lev 17-26 zu den rechtlichen? Matthias Hopf klart zunachst umfassend und mehrdimensional die Frage der Einordnung als Recht auch unter Zuhilfenahme rechtsanthropologischer Zugange. In einem zweiten Schritt beleuchtet er das Zusammenspiel rechtlicher und ethischer Anteile in diesem Textkorpus. Dabei kommen Einsichten der sog. “Emotional Studies” zur Anwendung. Uberlegungen zur Heiligkeit legen schliesslich deren Schlusselrolle als vermittelndes Element zwischen Recht und Ethos offen. In der Zusammenschau wird das Heiligkeitsgesetz als intentionale Mischform aus Elementen von Recht, Ethos und Kult erkennbar. Es erweist sich so als Ausdruck einer umfassenden Rechtstheologie.
