Abduction generally refers to a logical operation in which new explanatory hypotheses are formed. In abduction, an inference is made from the effect to the cause, from the consequences to the antecedents, a conclusion is drawn from a result by way of a rule to the case. The abductive way of thinking in the context of Talmudic legal hermeneutics provides integrated normative correctness controls in the interpretation of the existing legal traditions. The abductive argumentation examines the sense of the transmitted adjudication from the perspective of its normative acceptability. German description: Abduktion als eine kreative und zugleich disziplinierte Verfahrensweise zur Auffindung von Hypothesen weist eine logische Struktur aus, die am Ergebnis ansetzt und uber eine Regel auf den (konkreten) Fall hinfuhrt. Im talmudischen Rechtsdiskurs ist diese Schlussfigur ein normativ angelegter, problemorientierter hermeneutischer Topos, in dessen Rahmen ein Einverstandnis uber den Geltungsanspruch der zu deutenden Norm durch eine so genannte Reparatur der Ausgangsdaten herbeigefuhrt wird.Ronen Reichman zeigt abduktives Denken im Talmud als Gegenpol zu den Denkschranken des Rechtspositivismus auf. Ausgehend von der pragmatischen Bedeutungstheorie Habermas’ (wir verstehen einen Sprechakt, wenn wir wissen, was ihn akzeptabel macht) erarbeitet er, wie die abduktive Interpretation die interne Verknupfung zwischen Geltung und Bedeutung aufrechterhalt. Durch die Abgrenzung abduktiven Schliessens von den deduktiven und induktiven Schlussformen einerseits und die Einbeziehung der pragmatischen Bedeutungstheorie andererseits bietet die Studie eine neue systematische Herangehensweise zur Erschliessung talmudischer Rechtshermeneutik.
