Alla fine del medio evo (secoli XIII-XV) mentre nell’Italia di vecchia tradizione comunale i regimi signorili e principeschi intensificavano il controllo sui comportamenti sociali, anche le attivita ludiche diventavano motivo di crescenti attenzioni. Le autorita civili e i rappresentanti della Chiesa si preoccuparono soprattutto di combattere l’azzardo. Tuttavia fu indispensabile concedere qualcosa all'”infame” vizio, giungendo persino, con l’istituzione della casa da gioco pubblica (la baratteria), a trarne talora un vantaggio economico. Cresceva, inoltre, nelle autorita laiche la consapevolezza del valore strumentale del gioco, e non solo a fini addestrativi e di ricreazione, ma anche propagandistici e sociali; il palio diventava, cosi, il gioco “pubblico” dell’Italia di tradizione comunale fra Tre e Quattrocento: espressione della memoria cittadina e momento in cui far confluire istanze religiose e politiche. Anche la Chiesa giunse alla fine a riconoscere la necessita del gioco: cosi, alle soglie di una nuova eta, se lo stato aveva assunto il monopolio dei grandi spettacoli pubblici, la Chiesa avrebbe cercato di controllare, almeno in parte, la ludicita dei singoli.
