Folter ist in einem Rechtsstaat selbst in Notwehr- und Notstandssituationen nicht zu legitimieren. Auch die Totung von Menschen zur Rettung anderer ist nicht zu rechtfertigen; allenfalls ist eine Entschuldigung denkbar.


English summary: This book deals with two issues which have been discussed in jurisprudence, ethics and political philosophy for severeal years. In the first part, the main question is whether or not the use of torture can be legitimised. There are two cases in discussion: first the threat of torture against a kidnapper to rescue the victim of kidnapping, second the so called ‘ticking-bomb-scenario’. The text presents the different opinions within the international discussions and criticises those opinions, which advocate the legitimation of torture in this circumstances. In the second part the book deals with the legal problems the shootdown of a hijacked airplane will have. The case in mind is a situation like the 9/11-act of terrorism. The first chapter of this part discusses the legal consequences the shootdown may have. The final chapter reconsiders the 9/11-case within the context of Carl Schmitt’s Political Theology’. Besides the presentation and critical discussion of the several opinions the author will develops own solutions to all of the mentioned cases. German description: Das Buch behandelt zwei Themen, die seit einigen Jahren in der Rechtswissenschaft, der Ethik und der politischen Philosophie diskutiert werden. Erstens: Kann der Einsatz von Foltermassnahmen u.U. legitimiert werden? Entlang zweier Fallkonstellationen – einem Entfuhrer angedrohte Folter zur Rettung des Opfers und das sog. Ticking-bomb-Szenario – gibt der Text den internationalen Meinungsstand wieder und pruft die folterlegitimierenden Ansatze kritisch. Im zweiten Teil geht es, am Beispiel des Terrorakts vom 11. September 2001, um die rechtliche Behandlung des moglichen Abschusses eines von Terroristen entfuhrten Flugzeugs. Das Schlusskapitel erortert den Fall im Kontext der Politischen Theologie von Carl Schmitt. Neben der Darstellung unterschiedlicher Ansichten entwickelt der Autor jeweils eigene Losungen.
