Il volume e dedicato al De excusationibus di Erennio Modestino, unico scritto della giurisprudenza romana composto in greco, sebbene noto con un titolo latino. L’opera fornisce un importante contributo alla conoscenza dell’applicazione del diritto romano nelle province orientali dell’impero subito dopo la Constitutio Antoniniana. Essa si occupa della nomina e della conferma dei tutori e dei curatori, dei motivi di esonero e delle relative regole procedurali. L’attivita di Modestino, giurista e funzionario imperiale la cui origine resta incerta, si svolge entro la prima meta del III secolo, sullo sfondo della crisi che travolgera il mondo romano e portera al totale accentramento del potere nelle mani del princeps. Seguendo lo schema della Collana, il volume si apre con una biografia dell’autore (Viarengo) e un’introduzione (Maffi, Stolte, Viarengo), nella quale vengono affrontati i problemi della struttura originale dell’opera, dei suoi scopi, dell’uso della lingua greca e del recepimento nei Basilici. Viene poi presentato il testo greco nell’edizione di Mommsen (con la proposta di alcune varianti a cura di Stolte), una traduzione italiana annotata (Maffi) e un analitico commento (Viarengo, Maffi).
