In this work, the author puts access to the court into the context of the theory of democracy and explicates access to administrative jurisdiction as a facilitation of deliberation. The result of this study is an update of administrative legal protection in a modern democracy.
Berit Volzmann stellt den Zugang zu Gericht in einen demokratietheoretischen Kontext und arbeitet den Zugang zur Verwaltungsgerichtsbarkeit als Ermoglichung von Deliberation heraus. Sie zeigt die historischen Grunde fur die Entwicklung des Systems subjektiven Rechtsschutzes und die zugrundeliegenden funktionalen Pramissen auf und analysiert die Schwachen des bisherigen Systems. Die aus dem demokratietheoretischen Zugriff gewonnenen Erkenntnisse vergleicht die Autorin mit dem Zugang zur gerichtlichen Verwaltungskontrolle in Frankreich und der Schweiz. Auch die bereits erfolgten Weiterungen der Zugangsmoglichkeit im deutschen System -originar nationaler, wie auch unional und volkerrechtlich angestossener – werden demokratietheoretisch eingeordnet. Die Abhandlung mundet in einer Aktualisierung des Verwaltungsrechtsschutzes in der modernen Demokratie.
