English summary: In the fourteenth century, Saxon jurists compiled the first scholarly commentary on the “Saxon Law,” and with it they laid the foundations for the academic study of German law on its own terms. Maike Huneke’s investigation is concerned with the virtually unstudied glosses on the “Saxon Feudal Law,” as well as the better known gloss on the common law section of the “Sachsenspiegel,” one of the most important sources for medieval German feudal law. A spectrum-based classification of contemporary sources highlights their importance as early witnesses of learned Saxon jurisprudence, as representatives of a “jurisprudentia romano-saxonica.” This text-critical reappraisal of the manuscript tradition shows that the longer gloss of the “Sachsenspiegel-Feudal Law,” edited and published in 2013, was an authorized, original version. What is more, legal techniques also show scholarly engagement with the indigenous “Saxon Feudal Law” through the application of scholarly methods. On the basis of theoretical legal evidence, it can be shown that the still-anonymous glossator dealt with “Saxon Feudal Law” as an independent legal text in addition to common and local law. In the end, the legal gloss proves to be a characteristic representative of early German jurisprudence, as evidence of an early vernacular reception, and as an important witness for the rationalization and professional development of late medieval legal life. German description: Im 14.
