This volume collects essays based on presentations given at two international study meetings, “The Germans and the Roman Empire. History and Rights,” held between March 2024 and March 2025. It features contributions from Mauro Grondona, Thorsten Keiser, Orazio Licandro, Lauretta Maganzani, Fabrizio Oppedisano, Massimo Panebianco, Paolo Peduto, Giovanni Maria Riccio, with prefaces by Boudewijn Sirks and Antonio Padoa-Schioppa. These authoritative scholars from various scientific disciplines, with their diverse essays, contribute to tracing an ideal path through which contemporary institutions can be interpreted in a different light. The world of law, more than ever in this century, finds itself faced with rapid changes, phenomena unthinkable until a few years ago, fluid, requiring regulation, classifiable into categories and/or types, coordinated within a common vision. In a global, universal context, therefore, a correct reading of new realities and a judgment of their conformity within and of the legal system appears essential. This is not a foregone conclusion, given that a sort of dichotomy between type and dogma is deeply rooted, often elevated to a petitio principii, also the result of a divergence between different cultures, which in this case pertain, respectively, to the Roman and Germanic worlds. It is not necessary, or perhaps useful, to make value judgments on the outcome of this cultural encounter, or whether it should be interpreted as a regression in legal civilization; however, one cannot ignore, in a hermeneutic or normative construction operation, the transformation emerging in the developments of legal thought from Late Antiquity, then the Middle Ages, up to the contemporary era.
