Against the background of recent high-profile cases, such as the diesel emissions scandal, Carsten Konig examines the foundations of corporate liability in German tort law. Drawing on legal doctrine, economic analysis and comparative law, he argues for a more organisational approach to corporate liability.
Nach traditionellem Verstandnis knupft die deliktische Unternehmenshaftung an individuelles menschliches Verhalten an. Welche Schwierigkeiten sich daraus ergeben, haben jungst die “Dieselfalle” in Erinnerung gerufen. Carsten Konig pladiert dafur, die Unternehmenshaftung starker organisationsbezogen zu konstruieren. Hierfur fuhrt er neben rechtsdogmatischen vor allem rechtsokonomische Argumente an. Inspiriert durch rechtsvergleichende Betrachtungen schlagt er vor, zwischen direkter und indirekter Unternehmenshaftung zu unterscheiden und erstere gegenuber letzterer zu starken. Er entwickelt eine differenzierte Dogmatik der direkten Unternehmenshaftung, die er sodann fur die Unternehmens-Gefahrdungshaftung, die Unternehmens-Fahrlassigkeitshaftung und die Unternehmens-Vorsatzhaftung konkretisiert.
