Die deutsche Rechtsgeschichte hat in den letzten Jahrzehnten den Rechtsbegriff des Mittelalters unter neuen Paradigmen uberdacht und damit einen Beitrag zu einem neuen Bild des Mittelalters insgesamt geleistet. Die Aufsatze Gerhard Dilchers spielen in diesem Diskurs eine massgebende Rolle. Pragend fur diese Zeit war das typisch europaisch-mittelalterliche Spannungsfeld zwischen Oralitat und Schriftkultur. Dilcher untersucht etwa den mythischen Ursprung und die historische Herkunft als Legitimation mittelalterlicher Rechtsaufzeichnungen zwischen Leges und Sachsenspiegel. Auch der mittelalterliche Kaisergedanke als Rechtslegitimation wird thematisiert. Das langobardische Recht als typisches Volksrecht im italienischen Umfeld lateinischer Traditionen erweist sich als exemplarisch fur das Problemfeld Oralitat und Schriftlichkeit und wird in seiner Aussagekraft entfaltet und gegen einseitige Vereinnahmungen verteidigt.
