Zwei Tagungen des Jungen Forums Rechtsphilosophie werden in diesem Band dokumentiert: Die Beitrage der Munsteraner Tagung beleuchten die Befriedungsfunktion des Rechts. Sie untersuchen auf der Ebene der Normenbegrundung den Zusammenhang von Recht und Frieden in Hegels Konzeption einer Entfaltung des freien Willens, in der rechtspositivistischen Position Kelsens, im Hinblick auf ausserrechtliche Gerechtigkeitsentwurfe und aus konsequentialistischer Perspektive. Die Verbindungslinien zwischen Normenbegrundung und Rechtsanwendung werden anhand der Debatten um Praventionsrecht und Recht im Krieg sowie durch Fallstudien zu Militarinterventionen gezogen. Die Beitrage der Berliner Tagung befassen sich mit dem Zweck von Recht. Sie reichen von einer auf Hobbes basierenden Kritik an aktuellen empirisch-zweckmassigen Rechtsbegrundungen uber eine Reformulierung der kantischen Rechtsbegrundung fur das moderne Volkerrecht bis hin zur Einordnung von Recht als sozialem Krafteausgleich im Sinne Nietzsches. Zudem erortern sie die rechtskulturelle und gesellschaftliche Bedingtheit des Zwecks von Recht, die Bedrohungen fur ein begrundetes Recht durch die Europaisierung und ein emanzipatives Potenzial des Rechts.
