The Transformation of Contemporary Contract Law

Contemporary contract law finds itself in a phase of profound transformation. The classical premises concerning the equality of parties in commercial dealings – shaped in an era when the model of the undertaking assumed a relatively stable and predictable market structure – are today losing their pertinence. The fiction of contractual balance no longer corresponds to contemporary conditions of commercial activity under which the following phenomena predominate: the concentration of capital, information asymmetry, platformisation and the automation of distribution channels, and the far-reaching subordination of one party to the other in economic, organisational, and technological terms.
