»The Legal Theory and Scope of Application of Section 612 of the German Civil Code (BGB)«: This thesis examines § 612 of the German Civil Code (BGB), a classic provision of employment contract law. It focuses on the doctrinal classification of § 612(1) BGB. Contrary to the prevailing view, it is not a legal fiction but a rebuttable presumption that services are performed for compensation. In particular, the thesis examines its application to additional and special services by employees, including compensation for overtime and higher-value activities under employment contracts.
